TikTok, l\u2019une des applications de partage de vid\u00e9os les plus populaires, fait face \u00e0 une situation incertaine aux \u00c9tats-Unis<\/a>. Malgr\u00e9 un d\u00e9cret pr\u00e9sidentiel sign\u00e9 par Donald Trump, l\u2019interdiction de la plateforme reste en vigueur, et Apple ainsi que Google refusent de la r\u00e9int\u00e9grer sur leurs boutiques en ligne. Cette d\u00e9cision est li\u00e9e aux pr\u00e9occupations concernant les liens de TikTok avec sa maison m\u00e8re chinoise, ByteDance.<\/p>\n\n\n\n

Une interdiction fond\u00e9e sur des enjeux de s\u00e9curit\u00e9 nationale<\/h2>\n\n\n\n

L\u2019interdiction de TikTok d\u00e9coule des inqui\u00e9tudes des autorit\u00e9s am\u00e9ricaines concernant la s\u00e9curit\u00e9 nationale. ByteDance, la soci\u00e9t\u00e9 m\u00e8re de TikTok, est soup\u00e7onn\u00e9e d\u2019avoir des liens avec le gouvernement chinois, ce qui soul\u00e8ve des craintes quant \u00e0 l\u2019acc\u00e8s potentiel aux donn\u00e9es des utilisateurs am\u00e9ricains.<\/p>\n\n\n\n

En r\u00e9ponse, le gouvernement am\u00e9ricain a mis en place le Protecting Americans from Foreign Adversary Controlled Applications Act<\/strong>, qui emp\u00eache les applications contr\u00f4l\u00e9es par des entreprises jug\u00e9es probl\u00e9matiques de rester accessibles sur les plateformes num\u00e9riques.<\/p>\n\n\n\n

La position d\u2019Apple et Google<\/h2>\n\n\n\n

Malgr\u00e9 la signature d\u2019un d\u00e9cret pr\u00e9sidentiel accordant \u00e0 TikTok une protection temporaire de 75 jours contre l\u2019interdiction, Apple et Google maintiennent leur position. Dans un document de support publi\u00e9 r\u00e9cemment, Apple a pr\u00e9cis\u00e9 que TikTok, ainsi que toutes les applications d\u00e9velopp\u00e9es par ByteDance, ne seraient plus disponibles ou mises \u00e0 jour sur l\u2019App Store aux \u00c9tats-Unis. \u00ab Apple est tenue de respecter les lois en vigueur dans les juridictions o\u00f9 elle op\u00e8re. En vertu de la loi Protecting Americans from Foreign Adversary Controlled Applications Act, les applications d\u00e9velopp\u00e9es par ByteDance Ltd. et ses filiales, y compris TikTok, CapCut, Lemon8, et d\u2019autres, ne seront plus disponibles en t\u00e9l\u00e9chargement ou mises \u00e0 jour sur l\u2019App Store pour les utilisateurs aux \u00c9tats-Unis \u00e0 partir du 19 janvier 2025. \u00bb<\/p>\n<\/blockquote>\n\n\n\n

Un avenir incertain pour TikTok aux \u00c9tats-Unis<\/h2>\n\n\n\n

Selon plusieurs experts, le d\u00e9cret pr\u00e9sidentiel ne remet pas en cause l\u2019application de la loi f\u00e9d\u00e9rale. Pour que TikTok puisse continuer \u00e0 fonctionner aux \u00c9tats-Unis, le pr\u00e9sident devrait d\u00e9montrer au Congr\u00e8s que l\u2019application a coup\u00e9 ses liens avec ByteDance et qu\u2019elle est d\u00e9sormais contr\u00f4l\u00e9e par une entit\u00e9 am\u00e9ricaine. \u00c0 ce jour, aucune de ces conditions n\u2019a \u00e9t\u00e9 remplie.<\/p>\n\n\n\n

La structure actuelle de TikTok refl\u00e8te une r\u00e9partition de la propri\u00e9t\u00e9 o\u00f9 60 % des parts sont d\u00e9tenues par des investisseurs institutionnels tels que BlackRock, General Atlantic et le Carlyle Group. Les 40 % restants sont partag\u00e9s entre les fondateurs et les employ\u00e9s \u00e0 l\u2019\u00e9chelle mondiale.<\/p>\n\n\n\n

De grosses cons\u00e9quences pour les utilisateurs<\/h2>\n\n\n\n

Pour Apple et Google, le non-respect des lois pourrait entra\u00eener des amendes significatives, ce qui explique leur r\u00e9ticence \u00e0 r\u00e9int\u00e9grer TikTok sur leurs plateformes. En attendant une \u00e9volution juridique ou une restructuration de la propri\u00e9t\u00e9 de TikTok, les utilisateurs am\u00e9ricains devront trouver des alternatives ou se contenter des versions existantes de l\u2019application, sans possibilit\u00e9 de mise \u00e0 jour.<\/p>\n\n\n\n
